Amend Chapter 36 of the City Code regarding disorderly premises
Synopsis This Ordinance is being presented by City Council for Council’s review and approval. If approved, Council would be authorizing an amendment to Chapter 36 of the City Code to support and augment the City’s current nuisance property law. The Ordinance would define the term “disorderly premises” and provide penalties for those who allow for circumstances to arise creating a public inconvenience or annoyance through fighting or noise-making that threatens the peace and security of City neighborhoods. Those found guilty of violating this proposed law would be fined no less than $250 up to $1,000 for the first offense; $500 up to $2,500 for the second offense and $1000 up to $5,000 for a third and subsequent offence. The owner of a residential property who occupies the dwelling or the tenant would receive a criminal summons for a violation of this law while an absentee owner of the violating property could receive four points on the City’s Nuisance Property Point System. This law would be enforced by the Wilmington Police Department.
