#4539 An Ordinance to Amend Chapter 38 of the City Code Regarding Inclusive Parks
and Playgrounds (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Chapter 38 of the City Code to add a new
section specifying that all City parks and playgrounds that are either new or are
undergoing renovations shall be designed to be inclusive of and accessible to all
persons of differing abilities and allow for the active participation and
engagement of all persons, including those with physical, cognitive,
communicative, social, and/or emotional special needs. The intent of this
Ordinance is to ensure an inclusive, accessible and positive environment in which
our residents can experience the substantial benefits offered by public parks and
playgrounds.

#4508 Ord. 18-016 Approve the Removal of Portions of West 27th and 28th Streets
from the Official City Map (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the removal of portions of West 27th and
West 28th Streets from the Official City Map.

#4525 Ord. 18-021 To (I) Approve the Removal of a Portion of Downing Drive from
the Official City Map and (II) Accept the Dedication of a Cul-de-
sac as Part of the Newly Configured Downing Drive Right-of-Way

Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the removal of a portion of Downing Drive
from the Official City Map. This Ordinance also accepts the dedication of a cul-
de-sac at the terminus of Downing Drive to the City and authorizes its addition to
the Official City Map.

#4526 Sub. 1 Ord. 18-022 Authorize the Educational Access Channel Agreement between
Red Clay Consolidated School District and the City of Wilmington
(3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance authorizes the City to enter into an Educational Access
Channel Agreement with the Red Clay Consolidated School District. The
Educational Access Channel Agreement provides that the Red Clay Consolidated
School District shall operate and manage an educational access channel under
the City’s cable franchise agreement with Comcast for a two-year period
commencing on July 1, 2018 and ending on June 30, 2020. There will be no
annual cost to the City under the Educational Access Channel Agreement.

#4527 Ord. 18-023 Amend Chapter 2 of the City Code Regarding Storage of Tapes of
Council Meetings (3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Chapter 2 of the City Code related to storage
requirements for tapes of Council meetings. This Ordinance would ensure that
videos of standing committee meetings are included, and that language is
inclusive of electronic video footage, consistent with applicable provisions of
State law, and accounting for advancements in technology and the modernization of the City’s television station.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance approves various traffic and parking regulations in the
City.

#4540 A Resolution Scheduling a Public Hearing on July 12, 2018 Regarding the
Proposed Amendments to the Neighborhood Comprehensive Development Plan
for Browntown/Hedgeville
Synopsis: This Resolution is being presented by the Administration for Council’s review
and approval. This Resolution schedules a public hearing regarding the proposed
amendments to the Neighborhood Comprehensive Development Plan for
Browntown/Hedgeville on July 12, 2018 at 6:30 p.m. in the City Council
Chambers. This public hearing replaces the previously scheduled public hearing
of May 17, 2018 that was listed in Resolution No. 18-028.

separate but adjacent property also known as 0 Garasches Lane, being Tax

“Contract”), which provides the option of two (2) one-year extensions of the

Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the execution of Contract 19006PW –
Janitorial Services at the Municipal Complex – between the City of Wilmington
and Mid-Atlantic Services, A-Team Corp. for the period of one (1) year from July
1, 2018 through June 30, 2019, at an estimated price of One Hundred Thousand
Eight Hundred Seventy-Seven Dollars and Fifty-Two Cents ($100,877.52), with
the possibility of two (2) additional extensions of one (1) year thereafter at the
same annual price, at the option of the City.

#4546 An Ordinance to Authorize and Approve a Contract between the City of
Wilmington and Riggins, Inc. for Gasoline, Heating Oil, and Diesel Fuel (1st &

Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the execution of Contract 19017PW –
Gasoline/Heating Oil/Diesel Fuel – between the City of Wilmington and Riggins,
Inc. for the period of one (1) year from July 1, 2018 through June 30, 2019, at an
estimated price of One Million One Hundred Sixty-Nine Thousand Six Hundred
Sixty Dollars ($1,169,660.00), with the possibility of two (2) additional
extensions of one (1) year thereafter at the same annual price, at the option of the
City.

Insurance Services LLC for life and health insurance brokerage services for the

price of One Hundred Thirty-Five Thousand Dollars ($135,000.00), with the
possibility of three (3) extensions of one (1) year each thereafter upon the same
terms and conditions.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to enter into a contract with USI Insurance LLC for property and casualty insurance brokerage services for the term of one (1) year from July 1, 2018 through June 30, 2019 at an estimated price of Sixty Thousand Dollars ($60,000.00), with the possibility of three (3) extensions of one (1) year each thereafter upon the same terms and conditions.

#4532 Ord. 18-026 Amend Chapter 5 of the City Code Regarding the Head Tax
Abatement/Exemption Program (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s
review and approval. This Ordinance amends Chapter 5 of the City Code by
amending Section 5-102A thereof to extend the expiration date of the City’s head
tax abatement/exemption program until June 30, 2023.

Proposed Amendments to Chapter 48 of the City Code
Synopsis: This Resolution is being presented by the Administration for Council’s review
and approval. This Resolution schedules a public hearing regarding eleven
proposed amendments to Chapter 48 of the City Code on July 12, 2018 at 6:30
p.m. in the City Council Chambers.

#4549 An Ordinance to Amend Chapter 48 of the City Code to Update the Zoning Code
(1st & 2nd Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance is part of a comprehensive set of revisions to the City
Code to repeal certain provisions that are no longer necessary or appropriate
and to amend sections that require clarification or updating. This Ordinance
amends Chapter 48 of the City Code to make the following eleven changes to
Chapter 48 of the City Code: (1) eliminates the dedicated parking space
requirement for apartment houses in C-3 and C-4 districts because this
requirement is impractical and unnecessary; (2) eliminates the apartment house
specific FAR in C-4 districts, so that the applicable FAR is the same for all uses
in C-4 districts as is the case in the other commercial zoning districts; (3)
replaces a defunct cross reference to the Building Code with the applicable
language to improve clarity; (4) allows the Zoning Administrator to approve
reestablishment of a nonconforming use when the respective property has been
under active renovation during the period of non-use to make this process more
efficient; (5) adjusts the time required for permits to be pulled to repair a
property damaged by fire to make the timeline more practical; (6) allows parks or
playgrounds owned or operated by a nonprofit institution or community
association in O Zoning districts; (7) provides information regarding storm water
management best practices and storm water credits to promote better storm water
management in nonresidential parking lot designs; (8) clarifies that landscaping
requirements apply to all interior and perimeter landscaping and addresses the illegal removal of street trees; (9-10) removes references to a waterfront
development permit to reflect longstanding practice; and (11) adds a special
exception use to permit trade-like businesses in W-4 zoning districts with the
approval of the Zoning Board of Adjustment to further development in an
underutilized zoning district designation, while maintaining protections to ensure
the uses are in keeping with the district requirements.

Synopsis: This Ordinance is being introduced by the Administration for Council’s review and approval. This Ordinance authorizes the execution of Contract 19007PD - Police Clothing - between the City of Wilmington and Graves Uniforms, LLC for
the period of one (1) year from July 1, 2018 through June 30, 2019, at an estimated price of One Hundred Nine Thousand Five Hundred Four Dollars
($109,504.00), with the possibility of two (2) additional extensions of one (1) year thereafter at the same annual price, at the option of the City.
