#0093 A Resolution to Approve the License Agreement Authorizing Cellco Partnership
D/B/A Verizon Wireless to Install and Operate Wireless Telecommunication
Facilities in the Public Rights of Way of the City Of Wilmington
Synopsis: This Resolution is being presented by the Administration for Council’s review and
approval. This Resolution approves the License Agreement (“the License”)
between the City and Cellco Partnership d/b/a Verizon Wireless to, among, other
things, construct, install, maintain, and operate wireless telecommunication
facilities in the public rights of way of the City of Wilmington. This equipment is part of Verizon’s network for the operation of wireless communications services.
The initial term of the License is ten (10) years commencing on or about September
16, 2021 and shall continue thereafter until terminated by either party.

Ord. 21-041 Authorize and Approve a License Agreement Between the City of
Wilmington and Environmental Systems Research Institute, Inc.
(3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the execution of a license agreement between
the City of Wilmington and Environmental Systems Research Institute, Inc. for
access to software to apply geographic information system technology to many
operational and technical areas within the City for the period of three (3) years
from September 22, 2021 through September 21, 2024.

Ord. 21-042 Authorize and Approve a Discount Disposal Fee Agreement
Between the City of Wilmington and the Delaware Solid Waste
Authority (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance authorizes the execution of a discount disposal fee
agreement between the City of Wilmington and the Delaware Solid Waste Authority
for receipt and disposal of solid waste and receipt and processing of recyclable
materials for the period of three (3) years from July 1, 2021 through June 30, 2024.

21-040 to Amend Chapter 48 of the City Code Regarding Uses Permitted in the
W-4 (Waterfront Residential/Commercial) Zoning District and Parking Lot
Landscaping Requirements for All Waterfront Zoning Districts
Synopsis: This Resolution is being presented by the Administration for Council’s review and
approval. This Resolution schedules a public hearing on October 7, 2021 at 6:30
p.m. regarding the proposed amendments to Chapter 48 of the City Code
regarding uses permitted in the W-4 (Waterfront Residential/Commercial) zoning
district and parking lot landscaping requirements for all waterfront zoning
districts.

#0091 Ord. 21-045 Amend Chapter 40 of the City Code to Change the Observation of
Veterans’ Day as a Paid Holiday for Eligible City Employees to the
Eleventh Day of November (3rd & Final Reading) Synopsis: This Ordinance is being presented by the Administration for Council’s review
and approval. This Ordinance amends Chapter 40 of the City Code to change the
observation of Veterans’ Day as a paid holiday for eligible City employees from
the fourth Monday in October to the eleventh day of November.

A Resolution Approving Members Appointed by Mayor Purzycki to the
Wilmington Ethics Commission
Synopsis: This Resolution is being presented by the Administration for Council’s review and
approval. By this Resolution, City Council expresses its concurrence with Mayor
Michael S. Purzycki’s reappointment of William D. Johnston, Katherine Klocko,
Faith Meisinger-Petit, Melvin Phillips, and Charles H. Toliver, IV to the
Wilmington Ethics Commission, effective as of the date of passage of this
Resolution.

#0090 Ord. 21-044 Amend Chapter 2 of the City Code to Require Annual Ethics
Training and to Revise the Procedure to Amend the City Ethics
Requirements (3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Chapter 2 of the City Code to require all Elected
Officials, Appointed Officials, and City Employees to attend an ethics training
presentation approved by the Wilmington Ethics Commission or view a recorded
ethics training presentation approved by the Wilmington Ethics Commission on an
annual basis. In addition, this Ordinance creates a new procedure for amending
the City’s ethics rules to provide an opportunity for the Wilmington Ethics
Commission to review and make recommendations on such proposed amendments.
Finally, as a housekeeping matter, this Ordinance deletes some language from and
adds some language to City Code Section 2-345(a) to clarify the jurisdiction of the
Wilmington Ethics Commission as established by City Code Section 2-343.
