#4572 A Resolution Encouraging the Wilmington Fire Department and Wilmington
Police Department to Continue Education and Enforcement Efforts Concerning
Fireworks
Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution encourages the Wilmington Fire Department and the
Wilmington Police Department to continue to educate the public on the potential
dangers and risks associated with fireworks and other pyrotechnic devices, and to
enforce the restrictions set forth in the Delaware State Code pertaining to the
inappropriate usage of fireworks.
#4570 Ord. 18-044 Approve the Removal of Alico Road from the Official City Map
(3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for City Council’s
review and approval. This Ordinance authorizes the removal of Alico Road from
the Official City Map.
#4573 A Resolution Declaring Alico Road to be Surplus and Approving the Property for
Disposition to the State of Delaware
Synopsis: This Resolution is being presented by the Administration for City Council’s
review and approval. This Resolution declares Alico Road to be surplus and
approves the property for disposition to the State of Delaware.

#4574 A Resolution Encouraging the Delaware General Assembly to Introduce
Legislation Related to Expungement
Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution urges the Delaware General Assembly to introduce and
pass legislation that enables the automatic expungement of arrests not leading to
conviction from an individual’s criminal record. Furthermore, the resolution calls
for a modification of expungement guidelines in allowing for expungement of
misdemeanor convictions for individuals who have avoided arrest or prosecution
for ten years, or five years for summary offenses. The adoption of such legislation
would move more Delawareans toward productive and fulfilling lives,
systematically reducing the likelihood of recidivism while encouraging an
individual’s reintegration back into society.
#4575 A Resolution to Authorize and Approve the First Amendment to a License
Agreement between the City of Wilmington and T-Mobile Northeast LLC
Regarding a Water Tower on or near New Castle Avenue (Route 9)
Synopsis: This Resolution is being presented by the Administration for Council’s review and
Approval. This Resolution approves the First Amendment to a License Agreement
between the City and T-Mobile Northeast, LLC (“T-Mobile”), which permits TMobile
to install and operate communications antennas on and a control cabinet
at the base of the City’s water tower located on or near New Castle Avenue
(Route 9), sometimes referred to as Paper Place, Wilmington, Delaware. The
First Amendment will: 1) extend the term of the License Agreement for an
additional five (5) years commencing on July 1, 2019; 2) increase the license fee
payable by T-Mobile to the City under the License Agreement to $49,000 per year
with an increase of four percent (4%) annually commencing on July 1, 2019; and
3) provide T-Mobile with an option to renew the License Agreement for two (2)
additional terms of five (5) years thereafter.
#4576 An Ordinance to Amend Chapter 5 of the City Code Regarding Beverages
Offered in Children’s Meals (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
Approval. This Ordinance amends Chapter 5 of the City Code by requiring
healthy beverages to be offered as the default beverage offered with a
combination children’s meal inclusive of a drink, sold together at a single price.
This ordinance does not prohibit a restaurant’s ability to sell, or a customer’s
ability to purchase a substitute or alternative beverage if requested by the
customer.

#4577 A Resolution Naming the Playground in Father Tucker Park as the “Barbara
DelleDonne Memorial Playground”
Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution names the playground in Father Tucker Park as the
“Barbara DelleDonne Memorial Playground” in recognition of the meaningful
impact that Mrs. Barbara DelleDone, a prominent Wilmingtonian, had
throughout the City of Wilmington.

#4547 Ord. 18-039 Amend Chapter 42 of The City Code Relating to the Installation of
Wireless Telecommunications Facilities in the Public Rights of
Way (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for Council’s review and
approval. This Ordinance amends Chapter 42 of the City Code by establishing
procedures relating to the authorization, permitting and regulation of wireless
telecommunications facilities in the public rights of way.

Department to the Special Law Enforcement Assistance Fund for Technology
Improvements and Advanced Training
Synopsis: This Resolution is being presented by the Administration for City Council’s
review and approval. If approved, Council will be authorizing the Wilmington
Police Department’s application for a grant from Delaware Department of
Justice for funding from the Special Law Enforcement Assistance fund in the
amount of $90,000.00. The funds will be used to purchase Microsoft Surface Pro
Tablets and pay for advanced training for officers. No local matching funds are
required.
#4579 A Resolution Approving a Grant Application by the Wilmington Police
Department to the State of Delaware for Overtime to Combat Violent Crime
Synopsis: This Resolution is being presented by the Administration for City Council’s
review and approval. If approved, Council will be authorizing the Wilmington
Police Department’s application for a Fund to Combat Violent Crime Grant from
the State of Delaware in the amount of $420,666.72. The funds will be used for an
overtime program focused on combatting violent crime using intelligence driven
data to direct the overtime to particular areas and utilizing patrols, walking
assignments, tactical response initiatives, and plain clothes operations. No local
matching funds are required.

Department to the U.S. Department of Justice for Anti-Violence Overtime and
Salary for a Civilian Cold Case Investigator
Synopsis: This Resolution is being presented by the Administration for City Council’s
review and approval. If approved, Council will be authorizing the Wilmington
Police Department’s application for an Edward Byrne Memorial Justice
Assistance Grant from the U.S Department of Justice in the amount of
$224,448.00. The funds will be used for anti-violence overtime and the salary for
one civilian cold case investigator. No local matching funds are required.

Department to the Delaware Criminal Justice Council to Fund Technology
Improvements and a Citizen Survey
Synopsis: This Resolution is being presented by the Administration for City Council’s
review and approval. If approved, Council will be authorizing the Wilmington
Police Department’s application for a subgrant from the Delaware Criminal
Justice Council in the amount of $700,000.00. The funds will be used to fund a
police survey of citizens and Shot Spotter expansion for Wilmington Smart
Policing-Reducing Violence and Shootings. No local matching funds are
required.
