#4276 A Resolution Approving the “First Amendment to License Agreement” between
the City of Wilmington and T-Mobile Northeast, LLC to Continue to Permit TMobile
to Operate and Maintain Personal Communications Equipment on the City
Tower Located at 200 Presidential Drive (also known as Monroe Park)
Synopsis: This Resolution is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be authorizing an amended licensing agreement
between the City and T-Mobile Northeast LLC for T-Mobile to continue to operate and maintain
communications equipment on a City water tower located in Greenville at Monroe Park. The
five-year agreement requires T-Mobile to pay the City $22,580 for the first year with a 3%
increase for each of the remaining four years of the contract. The agreement contains two, fiveyear
extension period options.

#4264 Ord. 16-048 Amend Chapter 40 of the City Code Regarding Medical
Requirements of Employees (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be amending Chapter 40 of the City Code (the
Personnel Code) by replacing Section 40-54 to comply with the Americans with Disabilities Act.
#4273 Ord. 16-051 Amend Chapter 2 of the City Code Regarding the Establishment of
Council Organizational Fund (3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval.
If approved, the Council would be establishing a Council Organizational Fund which would be
funded through an appropriation by City Council at the beginning of the fiscal year in which
Council elections are held. The fund would be available every four years and would be managed
by the incoming Council President to, among other things, plan and execute the first meeting of
the new session of City Council, which includes each member being sworn into office, or fund
informational and education materials, sessions or meetings to acquaint each new and returning
member about council rules, legislative processes and their duties and responsibilities to the
citizens they serve.
#4274 Ord. 16-052 Constituting Amendment No. 2 to Fiscal Year 2017 Operating
Budget (Being an Ordinance to Amend Substitute No. 1 to
Ordinance No. 16-018, As Amended) (ASFSME Local 320 and
1102, IAFF 1590 and FOP Lodge #1) as well as the City’s Non-
Union Employees (3rd & Final Reading)
Synopsis: This Ordinance is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be authorizing the appropriation of $6.7 million to
fund employee contracts with the City’s public employee unions (ASFSCME Locals 320 and
1102, IAFF 1590 and FOP Lodge #1) as well as with the City’s non-union employees. The $6.7
million would be appropriated from the City’s Unassigned Fund Balance.

Federation of State, County and Municipal Employees, AFL-CIO, Local 320 and
the City of Wilmington to be Effective as of July 1, 2015 through June 30, 2018
Synopsis: This Resolution is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be approving an amendment to the Collective
Bargaining Agreement between the City and AFSCME Local 320 that was originally approved
by Council on November 19, 2015. The amendment provides salary increases for FY 2017 and
FY 2018, certain one-time payments, paid parental leave and a revised health insurance and
benefit plan as well as other provisions of the contract.

Synopsis: This Resolution is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be approving an amendment to a Collective
Bargaining Agreement between the City and AFSCME Local 1102 that was originally approved
by Council on November 19, 2015. The amendment provides salary increases for FY 2017 and
FY 2018, certain one-time payments, paid parental leave, a revised health insurance and benefit
plan as well as other provisions of the contract.
#4279 A Resolution Authorizing the Agreement between The Fraternal Order of Police
Lodge #1 (Rank and File) and the City of Wilmington for the Term of July 1,
2011 through June 30, 2016
Synopsis: This Resolution is being presented by the Administration for City Council’s review
and approval. If approved, the Council would be approving a collective bargaining agreement
(CBA) negotiated by the City Administration with the Fraternal Order of Police (FOP) Lodge #1
(Rank and File) for the period of July 1, 2011 through June 30, 2016.
#4280 An Ordinance Constituting Amendment No. 3 to Fiscal Year 2017 Operating
Budget (Being an Ordinance to Amend Substitute No. 1 to Ordinance No. 16-018,
As Amended) (Organizational Funds for President-Elect City Council) (1st & 2nd
Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and approval.
If approved, the Council would be authorizing an appropriation for $30,000 from the City’s
Unassigned Fun Balance for the Council Organizational Fund. This Fund would pay for
expenses related to orientation, education and information for newly elected and/or re-elected
Members of Council who will become Members of the next session of City Council on the
Tuesday following the first Monday in January following an election.
#4281 An Ordinance Constituting Amendment No. 4 to Fiscal Year 2017 Operating
Budget (Being an Ordinance to Amend Substitute No. 1 to Ordinance No. 16-018,
As Amended) (Transitional Funds for Treasurer-Elect) (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by Council for City Council’s review and approval.
If approved, the Council would be authorizing an appropriation of $25,000 from the City’s
Unassigned Fund Balance to be used by the City’s Treasurer-Elect for a transition process.
