Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution accepts into the record the report of the Council
Organization Commission, which was established by Resolution 16-060.
#4455 A Resolution Accepting and Adopting the Results of the Wilmington City
Council Strategic Planning Process
Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution accepts and adopts the results of the Wilmington City
Council Strategic Planning Process.
#4456 A Resolution Encouraging Congress to Consider Cities in Proposed Tax Reform
Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. If approved, Council would be encouraging the United States Congress
to factor in the financial challenges facing cities when considering proposed tax
reform.

#4457 An Ordinance to Enact Certain Parking Regulations (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by the Administration for City Council’s
review and approval. This Ordinance approves various parking regulations in the
City.

#4458 An Ordinance to Amend Chapter 36 of the City Code Regarding Weapons and
Related Offenses to Include Imitation Firearms (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Chapter 36 of the City Code to include a new
Section 36-168 that addresses the sale to and possession of imitation firearms by
minors, as well as markings required to be on imitation firearms by federal and
other laws. This Ordinance prohibits: 1) the sale of an imitation firearm to a
minor; 2) the possession of an imitation firearm by a minor, except under the
direct supervision of a parent or legal guardian; 3) the removal or obstruction of
the orange plug required by federal law for certain imitation firearms, or any
other colors or markings required to be on an imitation firearm under city, state,
or federal law; and 4) the possession of an imitation firearm on which the blaze
orange plug required by federal law or any other colors or markings required by
any city, state, or federal law have been removed or obscured.

#4449 An Ordinance to Amend Chapter 39 of the City Code to Allow Retired
Firefighters to Serve on the Fire Pension Board (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by the Administration for City Council’s
review and approval. This Ordinance amends Sections 39-182(a) and 39-251(a)
of the City Code to permit both active and retired members of the Wilmington
Fire Department enrolled in either the Firefighters’ Pension Fund (the “Old
Plan”) or the Wilmington Firefighters’ Pension Act of 1984 (the “New Plan”) to
run for the five firefighter positions on the board of trustees (the “Board”) that
administers the Old Plan and the New Plan. It also provides a procedure for an
active or retired firefighter enrolled in the Old Plan or the New Plan to place his
or her name on the ballot, allows active and retired firefighters enrolled in the
Old Plan or the New Plan to vote for the elected seats on the Board, and gives
priority for the Board’s elected seats to be filled by active members enrolled in
the Old Plan or the New Plan. Finally, as a housekeeping matter, the term
“personnel director” has been replaced with “human resources director”.
#4459 An Ordinance to Amend Chapter 37 of the City Code Regarding the Passing of
Municipal Vehicles on City Streets (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Chapter 37, Section 37-195 of the City
Code by expanding the safety protections afforded to municipal workers by
requiring passing motorists to change their lane of travel, if possible, and to
reduce their vehicle speed and proceed with caution when approaching a
stationary municipal vehicle display flashing amber or amber and white lights.

#4450 Ord. 17-047 Authorize an Agreement with Lerro Corporation to Provide On-
Site Engineering Services for WITN TV (3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance authorizes the City to enter into a three-year
agreement with Lerro Corporation to provide on-site engineering services for
WITN TV at an annual price of $15,000.00.
#4453 Ord. 17-048 Amend Chapter 5 of the City Code Regarding Hours of Operation
for Liquor Stores on Sundays (3rd & Final Reading)
Synopsis: This Ordinance is being presented by City Council for Council’s review and
approval. This Ordinance amends Section 5-1 of Chapter 5 of the City Code by
extending the permitted hours of operation on Sundays for liquor stores located
in the City of Wilmington to be from 11:00 a.m. to 6:00 p.m., except for liquor
stores constituting non-conforming uses. Liquor stores constituting non-conforming uses
are permitted to operate on Sundays from 12:00 p.m. to 4:00 p.m. This Ordinance
also extends the hours of operation for all liquor stores located in the City of
Wilmington for Christmas Eve and New Year’s Eve (in the event the holidays
occurs on a Sunday) to be from 11:00 a.m. to 8:00 p.m. Finally, as a
housekeeping matter, the phrases “at the licensee’s discretion” and “at his or
her discretion” have been deleted because they are duplicative of the term “may”.

Synopsis: This Resolution is being presented by City Council for Council’s review and
approval. This Resolution approves a grant by City Council to the Culture
Restoration Project (Behind Those Bars) in the amount of $10,000.

Department to the Delaware Criminal Justice Council to Support Advanced
Training
Synopsis: This Resolution is being presented by the Administration for Council’s review
and approval. This Resolution authorizes the Wilmington Police Department’s
application for a subgrant from the Delaware Criminal Justice Council in the
amount of $10,000.00. The funds will be used for advanced training to assist in
the implementation of a group violence reduction strategy. No local matching
funds are required.

Department to the State of Delaware for Funds to Provide Advanced Training and
Fund Overtime
Synopsis: This Resolution is being presented by the Administration for Council’s review
and approval. This Resolution authorizes the Wilmington Police Department’s grant
applications to the State of Delaware in the total amount of $60,742.81. The
funds will be used to provide advanced training including S.W.A.T. training, Pro-active
Internal Affairs Investigation Training, and Supervisory Leadership Training as
well as overtime funding for the Wilmington Police Department’s Drug, Vice and
Organized Crime Division. No local matching funds are required.
#4460 An Ordinance to Amend Chapter 36 of the City Code to Repeal Section 36-9
Thereof Regarding Regulation of Itinerant Performers (1st & 2nd Reading)
Synopsis: This Ordinance is being presented by City Council and the Administration for
Council’s review and approval. This Ordinance is part of a comprehensive set of
revisions to the City Code to repeal certain provisions that are no longer
necessary or appropriate and to amend sections that require clarification. This
Ordinance amends Chapter 36 of the City Code by repealing Section 36-9 thereof
because it has not been utilized and is unnecessary.
